Do I really need publication for my New York LLC?

Yes. New York LLC Law § 206 requires newspaper publication for six consecutive weeks in two papers in your county of formation, followed by filing a Certificate of Publication. Without it, your LLC can lose the right to sue in New York courts and faces other limitations.

What is the difference between a DBA and an LLC?

A DBA (Certificate of Assumed Name) lets an existing entity operate under another name — it creates no new entity, gives no liability protection, and has no separate EIN. An LLC is a new legal entity with liability protection and its own EIN. A DBA is best for additional brand names; an LLC is best for forming a separate business.
